James Stephensons Will
   In the name of God amen    September the twenty ninth 1747 I James Stephenson in the County of Chester and Township of Marpole being very sick and weak of body but of perfect mind and memory - thanks be given to God  therefore calling to mind the mortality of my body and knowing that it is appointed all men to die do make and ordain this my last will & testament, that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that give it and my body I recommend to earth to be buried in decent Christian burial at the discretion of my executor nothing doubting but at the general resurrection I shall recieve the same again by the mighty power of God  and as touching such worldy of  ____ where with it hath pleased God to bless me in this life I give demise and dispose of the same in the following manner and form   I give and bequeath to Agnes my dearly beloved wife the sum of thirty pounds lawful money of Pennsylvania to be raised and levied out of my estate   I give to my two sons (viz) John and William ____ freehold which is to be equally divided between them when come to minorities   likewise I give my beloved son James fifteen pounds like lawful money as aforesaid   If there is any money over and above I order and allow that it may go for his maintenance and I help to maintain my mother by the same if she be in need for it   I likewise constitute name and ordain as executors of this my last will and testament  viz  Mathew Cowden of the Township aforesaid and Arthur Nasmith in the Township of _____ and I do hereby utterly disallow revoke and disannull all and every other former testaments legacies and bequests and executors by me in any ways before named willed and bequeathed  Ratifying and confirming this and no other to be my last will and testament   In witness whereof I have hereunto set my hand and seal the day and year above written.

Then personally appeared Thomas Patton  Mathew Hopkins  the witnesses to the above will and on the ____ ____ ____ on the holy Evangelists of Almighty God do declare and say thay they were present and saw the testator above named sign seal publich pronounce and declare the above writing to be his last will and testament and at the doing thereof he was of sound mind and memory to the best of their understandings.   Jo Parker D.Reg.
Be it remembered that the fourteenth day of October Anno Dom 1747 the last will and testament of James Stephenson of the said County deceased was proved in due form of law and Probate and Letters of Admin. was granted to his friends Mathew Cowdon and Arthur Nasmith Solo Executors in the said will named being first attested well and truly to adminr. and to bring in an inventory of the deceased estate into the Reg Office at Chester County before the fifteenth day of November next to exhibit and also a plain and true account of their administration to rendor when legally thereunto required    Given under the seal of said office

   Thomas Penn and Richard Penn Esquires true and absolute Proprietaries & Governors in Chief of the Province of Pennsylvania and Counties of Newcastle Kent & Sussex upon Delaware   To all unto whom these Presents shall come  Greeting  Whereas in Pursuance of a Warrant under the seal of the Land Office bearing date the eleventh day of February one thousand seven hundred and forty three there was surveyed to James McConnell of the County of Lancaster a certain tract situate on Back Creek in Antrim Township formerly in the County of Lancaster now in the County of Cumberland   But the said James McConnell not complying with the conditions of the said Warrant the same together with the said survey so made ins & vertue thereof are become utterly void   As in and by thes said Warrant remaining in our Surveyor General's Office relation being thereunto had does manifestly appear And Whereas Arthur Nasmith and James Stephenson then of Chester County Yeomen afterwards purchased from the said James McConnell all his right title and interest of and in the said tract of land, if any he had  And the said James Stephenson, who is since deceased, having by his Last Will and Testament bearing date the twenty ninth day of September one thousand seven hundred and fortynine given and devised to his two sons John and William Stephenson his freehold estate (he having no other right to land save to the said tract) to be equally divided between them on their coming of age, the said Arthur nasmith, the acting executor of the said Will of the said James Steveneson, also since obtained our Warrant & under the seal of our Land Office aforesaid bearing date the twenty sixth day of September one thousand seven hundred and forty nine to our Surveyor General requiring him to make return into the Secretaries Office of the said survey of the said tract of land in order that the same might be granted and confirmed unto the said Arthur Nasmith in mannaer following,  that is to say,  on moeity for himself and the other moeity for the said devisees of the said James Stevenson   And in pursuance of the said last recited warrant the said survey of the said tract of land hath by our Surveyor Generals been since returned in to the Secretaries office and the same Tract is found to be bounded & described as follows viz:   Beginning at a marked ash tree standing on the East side of the said back Creek and from thence extending by lines of marked trees the six courses and distances next following viz:   South seventy degrees East forty four perches to a marked white oak  North twnety degrees East eighty perches to a marked white oak  North thirty degrees West thirty four perches to a marked white oak  North one hundred and sixty three perches to a marked white oak  North twenty degrees East ninety perches to a marked hickery and North seventy degrees West seventy two perches to a marked white oak  thence by Robert Donaldson's land South twnety degrees West one hundred perches to a marked chesnut and North seventy degrees West eighteen perches to a marked white oak  thence by a line of marked trees South twenty degrees West one hundred and fourteen perches to a marked white oak standing on the east side of the said Back Creek  thence down the same Creek on the several courses thereof two hundred & twenty eight perches to the place of beginning containing two hundred and sixteen acres and the usual allowance of six acres per cent for roads & highways   As in and by the said several Warrants and the said survey so made and returned into our Surveyor General's Office and from thence certified into the Secretaries Office may appear   Now at the Instance and Request of the said Arthur Nasmith and the said John Stephenson and William Stephenson that we would be pleased to grant him a confirmation of the same know ye that in consideration of the sum of thirty three pounds nine shillings & seven pence lawful money of Pennsylvania to our use paid by the said Arthur Nasmith and the said John & William Stephenson (The receipt whereof we do hereby acknowledged and thereof do acquit & forever discharge the said Arthur Nasmith and the said John Stephenson & William Stephenson their heirs and assigns by these presents)  And of the yearly Quit Rent herein after mentioned and reserved   We have given granted released and confirmed and by these presents for us our heirs & successors do give grant release and confirm unto the said Arthur Nasmith and John Stephenson and William Stephenson and their heirs and assigns the said two hundred and sixteen acres of land as the same are now set forth bounded & Limited as aforesaid with all mines minerals quarries meadows marshes savannahs swamps cripples woods underwoods timber & trees ways waters water-courses liberties profits commodities advantages hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining andm lying within the bounds & limits aforesaid three full & clear fifth parts of all Royal mines free from all deductions & reprisals for digging & refining the same   And also one fifth part of the ore of all other mines delivered at the pits mouth only excepted & hereby reserved   And also free leave right liberty to and for the said Arthur Naismith and John Stephenson & William Stephenson their heirs & assigns to hawk hunt fish and fowl in and upon the hereby granted land & premises or upon any part thereof   To have and to hold one moeity or equal half part of the said two hundred and sixteen acres tract of land and premises (except as before excepted) with their appurtenances unto the said Arthur Nasmith his heirs and assigns  to the only use and behoof of the said Arthur Nasmith his heirs & assigns forever   And to hold the other moeity or equal half part of the said tract of land and premises hereby granted (except as before excepted) with their appurtenances unto the said John Stephenson and William Stephenson their heirs and assigns forever   To be holden of us our heirs and successors Proprietaries of Pennsylvania as of our Manor of Lowther in the County of Cumberland aforesaid in free and common socage by fealty only in lieu of all other services    Yielding and paying therefore yearly unto us our heirs & successors at the Town of Carlisle in the said County at or upon the first day of March in every year from the first day of March last past one halfpenny sterling for every acre of the same or value thereof in coin current according as the exchange shall then be between our said province and the City of London to such person or persons as shall from time to time be appointed to recieve the same    And in case of nonpayment thereof within ninety days next after the same shall become due that then it shall & may be lawful for us our heirs & successors our & their reciever or recievers into and upon the hereby granted land and premises to reenter and the same to hold & possess until the said Quit Rent and all arrears thereof together with the charges accruing by means of such nonpayment & reentry be fully paid and discharged   Witness James Hamilton Esquire Lieutenant Governor of the said Province, who, by vertue of certain powers & authorities to him for this purpose, inter alia, granted by the said Proprietaries, hath hereunto set his hand and caused the Great Seal of the said Province to be hereunto affized at Philadelphia this twenty ninth day of August in the year of our Lord one thousand seven hundred & fifty three the twenty seventh year of the reign of King George the Second over Great Britain   And the thirty sixth year of the said Proprietaries government.
